About the Federal Appeals Process

Appellate law is a complex area of practice, and it is one that requires special education, training and experience if the attorney is to be successful. After you have found an attorney who is admitted to practice in appellate court, the first step is for your lawyer to file a notice of appeal.

Next, your attorney will prepare and then submit a written brief that summarizes the details of your case and outlines the reasons why you are seeking relief from the higher court. Depending on the circumstances, the appeal may also require your attorney to make oral arguments in the courtroom.

An appeal is not a new trial. It is instead a request to have the higher court review the original trial and determine whether you have been the victim of a miscarriage of justice. You cannot submit new evidence to the appeals court.

The appeals court will examine the evidence and the transcript, using this information to ascertain whether or not the lower court made any errors in the conduct of the original trial. The court may overturn the conviction, or may send the case back to the lower court for a retrial or resentencing.
